Instructional Fitness Disclaimer:During the State of Emergency declared by Governor Gavin Newsom concerning the pandemic caused by the COVID-19 virus and the closure of California State University, Long Beach, the Associated Students, Inc. (ASI) at California State University, Long Beach will provide on-line instructional workouts (“Activity”) through its Student Recreation and Wellness Center to persons (“Users”) who want to voluntarily participate. User acknowledges and agrees that participation in the Activity is voluntary. By logging into the Activity, User expressly agrees to release from liability the ASI, the State of California, the Trustees of the California State University, agents and employees, officers, directors, and volunteers of said entities for any and all acts and omissions of negligence and/or other wrongful misconduct by said entities and/or parties for any injuries, losses, illnesses, and/or damages including but not limited to wrongful death arising out of User’s voluntary participation in the Activity. User further agrees to waive any claim for injuries, losses, illnesses, and/or damages including but not limited to wrongful death arising out of User’s participation in the Activity. User understands and agrees that no claim shall be brought and/or lawsuit filed against ASI, the State of California, the Trustees of the California State University, agents and employees, officers, directors, and volunteers of the ASI and the California State University, Long Beach for any injuries, losses, illnesses, and/or damages including but not limited to wrongful death arising out of User’s voluntary participation in the Activity. User expressly waives any and all claims for injuries, losses, illnesses, and/or damages arising out of User’s participation in the Activity against the ASI, the State of California, the Trustees of the California State University, agents and employees, officers, directors, and volunteers of said entities.
